NRI Property Partition

NRI Property Partition Lawyer in Ahmedabad

If your sibling or another co-heir refuses to divide a family property and you’re stuck waiting from abroad, you don’t need their agreement to move forward. As your NRI property partition lawyer in Ahmedabad, Raval Law Associates files partition suits that force a legal division through the court, even when one co-owner refuses to cooperate. We handle the filing, the hearings, and the paperwork through a registered Power of Attorney, so you never need to travel to India for the case to proceed. Call us at +91 99099 57585 and we’ll review your property documents first.

Related Services by Raval Law Associates

A partition dispute rarely stays simple once a sibling digs in. We handle the full sequence, not just the filing.

  • Partition Suit Filing — We draft and file the suit in the civil court where the property sits, listing all co-owners, your claimed share, and the grounds for partition under the Hindu Succession Act or the Partition Act, 1893.
  • Injunctions to Stop Sale or Construction — If a sibling is trying to sell, mortgage, or build on the property while the case is pending, we apply for a court order to freeze that activity until the court rules on the partition.
  • Power of Attorney Drafting — We prepare a registered Power of Attorney so your representative in India can sign documents, attend hearings, and respond to court notices on your behalf.
  • Mutation & Record Correction After the Decree — Once the court grants the partition, we update the revenue records (jamabandi/mutation entries) in your name, so the new ownership shows up officially, not just on paper.
  • Mediation & Family Settlement — Where there’s still room for an amicable split, we draft and register a family settlement deed, which resolves the matter faster and avoids years of litigation.

Email us at legal@ravallawassociates.com with the property details and the names of the other co-owners, and we’ll map out which route fits your case.

FAQs

Can I force a partition if my sibling refuses to divide the property?

Yes. Any co-owner can file a partition suit in civil court, and the court doesn’t need every co-owner’s consent to order a division. Once you file, the court issues notice to the other co-owners, examines the title documents and revenue records, and decides each person’s share. Your sibling’s refusal slows down an amicable settlement, but it doesn’t block the legal route.

What happens if the property can’t be physically split, like a house?

The court appoints a local commissioner to inspect the property and report on whether it can be physically divided. If it can’t — which is common with a single house or a small commercial unit — the court orders a sale and splits the proceeds among the co-owners according to their shares.

My sibling already sold or built on part of the property without my consent — what can I do?

You can challenge it directly. Selling undivided ancestral property requires every co-owner’s consent, so a sale made without yours doesn’t hold up — the court can cancel the deed and restore the property to joint ownership. If construction is the issue, we can also seek an injunction to stop further building while the court decides the partition suit. Act on this as soon as you learn about it — waiting too long can weaken your position later.

Why Choose Raval Law Associates for NRI Property Partition

Advocate Parth Raval and Advocate Akanksha Raval each bring 9 years of experience handling partition and family property matters in Ahmedabad’s civil courts. That experience covers what actually matters in an NRI partition case:

  • Drafting partition suits that hold up against an uncooperative co-owner’s objections
  • Securing injunctions quickly when a sibling tries to sell or build during litigation
  • Coordinating directly with Ahmedabad’s revenue authorities for mutation after the decree

You’ll work with one of the founding advocates directly through every stage of the case, not a rotating team you have to re-explain your situation to from another time zone.
