Yes. Under Section 195 of the Income Tax Act, any tenant paying rent to an NRI landlord must deduct 31.2% TDS before the payment, regardless of how small the rent is — there’s no minimum threshold like there is for resident landlords. Your tenant needs a TAN to do this correctly and must issue you a TDS certificate each quarter. If your rental agreement doesn’t spell this out, tenants often deduct incorrectly or skip it entirely, which becomes your problem at tax filing time, not theirs.
You can act without traveling, as long as your rental agreement is properly drafted and registered. We send a formal legal notice first, and if your tenant still doesn’t pay or vacate, we file for eviction in the appropriate court using a Power of Attorney to represent you throughout.
