Yes. A partition suit isn’t limited to ancestral property. The same court process covers any property two or more co-owners hold jointly, whether they purchased it together, received it as a joint gift, or co-own it some other way. What happens if the property can’t be physically divided?

The court appoints a commissioner to assess whether a physical split is realistic. A single house or a small commercial unit often can’t be divided without destroying its value.
