What’s the difference between PASA detention and a normal criminal case?

A normal criminal case requires a trial and a conviction before anyone goes to jail. PASA skips that entirely. It lets the government detain someone preventively, based on a belief that their activities threaten public order, without a trial proving any specific crime. That’s exactly why courts scrutinize these orders carefully, and why challenging one looks different from defending a criminal charge.

My family member was detained — what happens next, and how long can this go on?

The authorities must disclose the grounds for detention within 7 days. The government then has to place the case before an Advisory Board within 3 weeks, and the Board must report back within 7 weeks of the detention date. We move immediately to prepare a representation for that Board, since this is often the fastest realistic path to release. If the Board confirms detention, we take the matter to the Gujarat High Court next.

Is having an FIR or two against someone enough to justify PASA detention?

Usually not, and Gujarat courts have said so repeatedly. Registering an FIR, or even several, doesn’t by itself prove a threat to public order. Courts distinguish between an ordinary law and order problem and an actual disturbance to the broader public order, and PASA only covers the second one.
