A personal dispute that happens to involve money doesn’t automatically qualify. We check both the value and the nature of the relationship before deciding where to file.
Yes, in most cases. The Supreme Court settled this in 2022. It ruled that pre-institution mediation under Section 12A is mandatory, not optional. Skip it, and the court can reject your plaint immediately, without even hearing the merits. We file the mediation application correctly the first time, so your case doesn’t get thrown out on a technicality before it begins.
Yes, but only if the urgency is real. The law lets you go straight to court if you genuinely need urgent interim relief. Stopping an asset transfer or freezing a bank account before damage becomes irreversible are good examples. Courts look closely at this exception. A vague claim of urgency doesn’t qualify.
