NRIs have the same inheritance rights as any resident heir. What’s different is everything that comes after, claiming property without traveling to India, moving proceeds abroad, and sometimes fighting a dispute from another country entirely. As your NRI inheritance lawyer in Ahmedabad, Raval Law Associates handles each of these pieces, so distance doesn’t cost you your rightful share. Call us at +91 99099 57585 and tell us about the inheritance and where you’re currently based.
Distance complicates inheritance, but it doesn’t have to stop it. We handle the parts that genuinely change when you live outside India.
Email us at legal@ravallawassociates.com with the inheritance details and your current location, and we’ll tell you exactly what the process looks like from where you are.
Yes, in most situations. A properly executed Power of Attorney, attested in your country of residence, lets us handle probate, succession certificate filings, mutation, and registration on your behalf. You’ll need to sign and attest the right documents at the right moments, but a trip to India usually isn’t required just to claim what’s rightfully yours.
You can keep it. FEMA blocks NRIs from buying agricultural land directly, but inheriting it works differently, and you’re free to hold it for as long as you want. Selling it is more limited. You can only sell to a resident Indian citizen, not to another NRI or OCI, and converting it to commercial or residential use needs separate state government approval. We structure any sale correctly within these limits.
Generally up to USD 1 million per financial year from your NRO account, once you’ve settled the tax position and met the bank’s documentation requirements. This limit applies per person, so multiple heirs each get their own allowance. There’s also a specific exception: if the deceased originally bought the property using NRE or FCNR funds, you can repatriate sale proceeds for up to two residential properties beyond the usual cap, up to the original foreign exchange amount invested. Going beyond these limits needs specific RBI approval, which we pursue directly when your situation calls for it.
Advocate Parth Raval and Advocate Akanksha Raval each bring 9 years of experience handling NRI inheritance matters in Ahmedabad. That experience covers what actually matters here:
You’ll work directly with one of the founding advocates on your matter, not a junior associate unfamiliar with how distance changes the process.
